Important: This is a legal agreement between you and Naksh. By installing or using the App, you agree to these terms. This EULA is between you and the developer, not Apple or Google.

1. License Grant

Subject to your compliance with this End User License Agreement (“EULA”), Naksh grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Naksh application (“App”) on devices that you own or control, solely for your personal, non-commercial purposes.

2. Restrictions

You may not:

  • Modify the App or create derivative works based on it
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Extract or systematically copy any portion of the knowledge base, including yoga rules, scripture mappings, evaluation matrices, interpretation templates, or provenance data
  • Remove any copyright, trademark, or other proprietary notices from the App
  • Distribute, sublicense, lease, rent, or lend the App to any third party
  • Transfer your license or account to another person
  • Use the App for any unlawful purpose or in violation of applicable laws
  • Circumvent any security, encryption, or access control mechanisms in the App

3. Ownership

The App, including all code, content, design, knowledge base data, and related intellectual property, is and remains the exclusive property of Naksh and its licensors. This EULA does not grant you any ownership rights in the App.

3.1 Knowledge Base

The Naksh knowledge base (301 yoga patterns, planetary evaluation rules, scripture verse mappings, interpretation template pools, and provenance metadata) is proprietary. All rights reserved.

3.2 EKM Protocol

The Encoded Kundali Matching (EKM) protocol, including the Kundali Trait Vector encoding system, privacy-preserving compatibility matching algorithms, and the three-Kuta standalone scoring method, is proprietary technology. Patent pending.

4. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to the data practices described therein.

5. Content Disclaimer

The App provides guidance based on classical Vedic timing principles and computational astronomy. All content is for informational, educational, and self-reflection purposes only. It is not professional advice of any kind. See our Disclaimer for full details.

6. Apple-Specific Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

  • Parties: This EULA is between you and Naksh (the developer), not between you and Apple Inc. Naksh, not Apple, is solely responsible for the App and its content.
  • Non-transferable: This license is limited to use on Apple-branded products that you own or control, as permitted by the App Store Terms of Service.
  • Maintenance and support: Naksh is solely responsible for providing maintenance and support services for the App. Apple has no obligation to provide any maintenance or support.
  • Warranty: Naksh is solely responsible for any product warranties, whether express or implied. In the event of a failure to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
  • Product claims: Naksh, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
  • Intellectual property: In the event of any third-party claim that the App infringes that party's intellectual property rights, Naksh, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
  • Legal compliance: You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

7. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce, trade and economic sanctions maintained by the Treasury Department's Office of Foreign Assets Control (OFAC), and the International Traffic in Arms Regulations maintained by the Department of State.

8. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination:

  • You must cease all use of the App
  • You must delete all copies of the App from your devices
  • Sections on ownership, disclaimers, limitation of liability, and governing law survive termination

9. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind. To the maximum extent permitted by law, Naksh disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall Naksh be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the App, regardless of the theory of liability.

Naksh's total aggregate liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the event giving rise to the claim, or fifty US dollars ($50), whichever is greater.

11. Governing Law

This EULA is governed by the laws of the State of New Jersey, United States, without regard to conflict of law principles.
